Abstract
This article reveals freedom of contract, one of the basic principles of civil law and within it depicts the principle of “bona fide”. It illustrates the appearing of freedom of contract and as well as gives a description about the role of will principle. At the same time, the article reveals what kind of promises that freedom gave, whether it was relative or absolute. There is also analyzed in which situations it has to be limited. As well as the establishment and legal characteristics of “bona fide” principle was analyzed. It was offered to our legislation system to change it. Within freedom of contract, the place and influence of the “bona fide” have been fully investigated.
