Abstract
The article examines the problem of ensuring a fair balance between government authority and human rights during emergencies in the context of the pandemic. The concept and elements of the state of emergency term and the mechanism of protection of human rights and freedoms in these conditions have been analyzed according to the international law and the legislation of the Republic of Azerbaijan. The legal basis for a special quarantine regime implemented to prevent the epidemics and allowed the use of restrictive measures towards human rights was also examined.
