Summary
This article is dedicated to the evaluation of place of Constitutional Court in the separation of powers. In addition, the necessity of establishment of the Court, the theories with regard to this establishment and their contemporary reasoning, and significance of its activity is analyzed. The article covers the conformity between character of authorities of Constitutional Court and its affiliation to the branch of separation of powers, suitability of the legal status defined in legislation, the collision of its functions with other branches of separation of powers. The comparative analyzes of the practice formed in the USA, France, Italy and other countries and demonstrated the pros and cons. There is appropriate and effective suggestions given on this issue at the conclusion part of the article.
